2002 LOCAL GOVERNMENT ELECTION – FINAL REPORT
Executive Summary
The Local Government Elections held on March 20, March 25 and May
20, 2002 were seriously flawed in at least 03 Municipal Councils, 03
Urban Councils and 22 Pradeshiya Sabhas, which comprised 9.0% of the
311 local government bodies polled. It is regretted that elections were
not held in 53 councils in the North-East Province, despite two
postponements and the current ceasefire. The 2002 LG elections differed
from other recent elections in that violence and violations were
concentrated on the day of the polls, and that too in a systematic and pre-
meditated way to avoid the censure of the Commissioner-General of
Elections by maintaining an intimidatory presence outside the polling
centres.
A cumulative total of 726 incidents of violence was reported to CMEV
during the three campaign periods, of which 365 (50.3%) were major
incidents, including 01 Murders and 02 Attempted Murders. Though
this may appear relatively peaceful in recent times, on election day an

unprecedented 1777 violations were recorded, seriously compromising
the democratic process in 979 polling centres. This too despite the fact
that CMEV was able to comprehensively monitor only 68 local
government bodies, which was just over 25% of the total.
The chief culprits during these elections were the UNP, supporters of
which party stand accused in 55.8% of all Pre-Election violations, 46.7%
of all incidents on election day, and 62.2% of all reports of post-election
violence. In contrast, PA supporters were the alleged perpetrators in
19.7%, 06.9% and 18.9% respectively.
The new trend of heightened violence and intimidation on the day of
polling does not bode well for future elections, since the Police is clearly
unable and unwilling to intervene, and the Commissioner-General does
not consider incidents directly outside the polling centre to be within his
purview. Among the most violent incidents on the three days of the poll
were 05 Murders, 07 Attempted Murders, 29 instances of Hurt, 05 of
Grievous Hurt, 51 Assaults, 03 reports of Arson, and 90 acts of Threat &
Intimidation.
The involvement of women in overt election violence is still relatively
low, though a significant number of women are targeted by men during

the campaign as well as on election day. Yet, disturbingly, CMEV’s
monitors have recorded an increase of women’s participation in
impersonation and illegal voting. More Women are still significantly
“victims” of violence than “perpetrators”.
A preliminary assessment of post-election violence during the first week
after the poll was also made by CMEV, and here too a similar pattern of
localized and personality-based violence was manifest. The problem is
exacerbated by the fact that the major political parties appear to condone
and countenance such blatant acts of violence and intimidation. Nor is
the Police willing or able to take punitive action against these prominent
perpetrators. Therefore, as the risks involved in acts of violence are
minimal and the rewards tangible, the violence will only escalate each
time.
Introduction
The 2002 election to Sri Lanka’s 18 Municipal Councils, 37 Urban
Councils, and 256 Pradeshiya Sabhas was held on March 20, 2002,
March 25,2002 and May 20, 2002, in all areas excluding the North-East
Province. The 53 local government bodies in the North-East were
scheduled to go to the polls on September 25, 2002, but this too was
postponed for another 09 months.

The CMEV local government election final report is a composite of all
these mini-elections. In each case pre-election violence consists of
incidents up to the eve of the date of that particular election, and post-
election reports account for violations up to three weeks from the day of
polling. It is only in this manner that any credible comparative analysis
of the election taken as a whole can be made.
Another difference between CMEV’s monitoring of this election and the
other major elections in the recent past, is the fact that we were only able
to systematically monitor a representative sample of just over 25%,
comprising 68 local government bodies located in 18 districts and all 08
.provinces out of a total of 228 held so far. On the one hand, CMEV did
not have the financial resources, nor the infrastructure to cover the entire
country, and on the other, coming as it did so soon after the 2001
December Parliamentary Election, there was hardly any time to launch
such an extensive operation from scratch. As repeatedly mentioned in
other CMEV Reports and elsewhere, this inability underscores the urgent
need for CMEV to have a permanent core staff and basic infrastructure,
as opposed to the ad hoc, election-by-election operating style it is forced
to adopt due to the lack of funds and infrastructure.

Pre-Election Violence:
A total of 726 incidents were recorded in the run-up to the respective
elections. Of these 365 (50.3%) are deemed Major, while 361 were
relatively less serious. One Murder, 02 Attempted Murders, 78
allegations of Hurt, 18 of Grievous Hurt, 173 Assaults, 33 Threats &
Intimidation, 02 cases of the Misuse of State Resources, 40 Robberies
and 18 acts of Arson comprise the major incidents, indicating that
though this election campaign was less important than the general
election that immediately preceded it, and though it was the first election
conducted with the new UNP government in power, the level of violence
was significant. 41 incidents (5.7%) involved the use of firearms, and 26
(3.6%) were directly polls-related such as the theft of polling cards.
Local government elections are traditionally the least violent of the
country’s elections, since there is less at stake than in the provincial,
parliamentary or presidential polls. The fact that over 50% of all
incidents reported were major ones is, therefore, a cause for concern.
Moreover, as the electorates had just got over the sustained violence of
the 2001 General Election and the extensive post-election retaliation, the
cumulative violence of the 2002 local government election must be
viewed as substantial and a disturbing pointer of future trends under the
newly-elected UNP regime.

In terms of geographical distribution, again the evidence points to
selective violence in areas where the powerful politicians involved share
a history of intimidation, election-rigging and similar violations
throughout the past decade or so. The fact that these outcomes are
predictable and have been documented by CMEV and other local and
international monitoring groups, and yet they continue unchecked,
renders faith in the Sri Lankan electoral system dubious. Even at this
stage, CMEV urges that the Commissioner of Elections, the Police and
judiciary, the respective parties, the mass media and the general public
take up this issue as an urgent priority in order to protect the sanctity and
credibility of the democratic process in this country.
The highest levels of violence recorded were from Nivithigala PS (21),
Minuwangoda PS (21), Ja Ela PS (19), Attanagalla PS (16), Gampaha
PS (15), Nattandiya PS and Kesbewa PS (14 each) which echoes the
statistics of the parliamentary election of December 2001, where many
of the selfsame areas were of the greatest concern. In some areas such as
the Hanguranketa PS, the intimidation was so complete that no one was
willing even to risk making a complaint.

Of the 726 complaints received the UNP was allegedly responsible for
405 (55.8%), while the PA stood accused in 143 (19.7%). Persons of
unknown political affiliation were the alleged perpetrators in 141
(19.4%) and the JVP in 14 (1.9%). This is perpetuates an unhealthy
precedent in the ruling party becoming embroiled in violence. From
1995 to 2001,the PA which was in power, allegedly caused over 50% of
the violations in all the elections held during that period. In its very first
opportunity since seizing control of the government, the UNP has been
able to emulate its rivals, despite all its promises to the contrary.
Considering types of violations committed, the PA and UNP taken
together are allegedly responsible for nearly 75% of all major incidents,
and over 90% of all incidents in which the political party of the
perpetrator has been identified. Thus, the pattern of two-party violence
still prevails, though the larger share is now with the UNP, as it was
during 1977 – 1994 when they formed the Government. During the run-
up to the election the PA made 224 complaints, 183 of which were
against the UNP and 39 against persons of unknown political affiliation.
The UNP/F made 277 complaints, 133 of which were against PA
supporters, 48 against persons of unknown political affiliation, and 73
against members of the UNP itself. This phenomenon of intra-party
rivalry and violence in Sri Lanka, which became liminal through the

preferential voting system, appears to be an invariable concomitant of
access to power. Thus, very high levels of intra-party violence (26.4% of
all UNP complaints) was experienced by the UNP at these local
government elections, while in 2001, for instance, it was the PA that was
in this position.
Of the 726 complaints received, 61 (8.4%) were made by women,
reflecting 25 major incidents and 36 minor. Only one of these incidents
involved the use of firearms, and 6 were directly polls-related. 23 of
these complainants were PA supporters, 30 UNP supporters , 05 JVP and
03 of unknown political affiliation. The alleged perpetrators of these
complaints were UNP (34), PA (15), JVP (01) and persons of unknown
political affiliation (11).
Women are the alleged perpetrators in 05 incidents, 01 of which was an
act of Hurt, 01 Grievous Hurt, 01 Assault, and 02 Threats. It is alleged in
the complaints that four of these women perpetrators were PA supporters
and the other was of unknown political affiliation. This is the first time
that CMEV has provided comprehensive data on the gendering of
election violence. Therefore, comparative analysis is not possible, but
given the fact that women’s representation as candidates in the election

is only 1263, the violence against women is significant and a measure of
the continuing brutalisation of our society.
Election Day Violence
CMEV monitored 54 PS divisions, 08 UC divisions, and 06 MC areas on
election day, employing over 500 day-monitors located at individual
polling centres, and 10 mobile teams. In addition, reports sent in by
political parties, individuals, police complaints and other courses were
documented and verified. A total of 1777 violations were recorded on
election day, seriously affecting the voting in 979 polling centres.
Firearms were used in 44 instances. Of these serious violations that
compromised the outcome of the election in these centres, the UNP is the
alleged perpetrator in 829 incidents (46.7%), the PA in 123 (06.9%), the
JVP in 09 (00.5%) and persons of unknown political affiliation in 796
(44.8%). Thus, the UNP was held accountable for 84.5% of all incidents
in which the political party of the perpetrator was allegedly identified.
The UNP and PA taken together account for 97% of all violations in
which the party affiliation of the perpetrator was indicated in the
complaint, and this is a clear index of the monopoly on violence that
these major parties perpetuate at each and every election in this country.
The total number of incidents appears to be higher than during the 2001
Parliamentary election, and the seriousness of these incidents leaves

In recent years, stripping of women and overtly sexualised violence has
been recorded, notably from the North-Western or Wayamba Province.
Women are under-nominated by all the political parties, and even in this
local government election women constituted 4.8% of all candidates. Of
the 1263 candidates nominated, 79 (1.8%) were elected to their
respective local government bodies. This gender inequality is
perpetuated within these bodies, with no women being selected by their
parties as Mayors or Chairs of the Pradeshiya Sabhas or Urban Councils.
Thus, it is clear that the major parties in particular need to ensure that
women enjoy higher nomination percentages and, when elected, great
access to positions of leadership.
