A responsible intervention by India is needed for effective solution in Sri Lanka
Civil society and Diaspora activists are deeply disappointed with the India’s position when the crime of genocide is being perpetrated against the Tamil speaking people in Sri Lanka and the deteriorating situation demands a robust intervention. There is clear evidence of racially motivated discrimination and a policy of dehumanization have denied a whole group of people their dignity, legitimate rights and the opportunity for equality for over several decades. India is well placed, by virtue of its cultural, economic and social ties with Sri Lanka for millennia, more than any other country, to protect the minorities from extreme abuse and help to resolve the conflict in the neighbouring island – “A responsible role” is the, expression used by many people who contacted the Tamil Information Centre (TIC), after the Joint Press statement issued in New Delhi follow- ing Sri Lankan President Mahinda Rajapaksa’s brother and Special Adviser Basil Rajapakse’s meeting with India’s External Affairs Minister Prnab Mukherjee, National Security Adviser M K Narayanan and Foreign Secretary Sivshankar Menon on 26 October 2008.
The two major factors that continue to influence India’s relations with Sri Lanka are security in the region and the shared ethnicity of Tamils living in southern India and in the northeast and plantations of Sri Lanka. This position is reflected clearly in the Indo-Sri Lanka Joint Press statement.
Since withdrawal of the British military presence in the Indian Ocean in the mid-1950s, both nations have increasingly shared regional security interests, and the position continues to this day. In the 1970s, New Delhi and Colombo enjoyed close ties on the strength of the relationship between Indira Gandhi and Sri Lanka’s Prime Minister, Mrs. Sirimavo Bandaranaike. India continued to take an interest in the status of the Sri Lankan Tamils, but without the direct intervention that characterized the 1980s. The complex issues involved in the direct intervention of India, by sending a peacekeeping force in 1987, marred relations between the two coun- tries. Bilateral relations, however, improved somewhat in the early 1990s, as the governments attempted to expand economic, scientific, and cultural cooperation. The May 1991 assassination of Rajiv Gandhi and the attack on EPRLF leaders in June 1990 in the Indian soil, forced New Delhi to crack down on the LTTE pres- ence in Tamil Nadu and to institute naval patrols in the Palk Strait to interdict LTTE movements to India. The hands-off approach by India and Tamil Nadu after the Rajiv assassination continued into the new millennium, but the intensity of the war since 2006 and the extreme human suffering in north-east Sri Lanka have seen a change of heart, and a call from Tamil Nadu for robust intervention.
The joint statement completely ignores the first two demands put forward by Tamil Nadu, namely, stop- ping the war and suspending military aid to Sri Lanka and has considered action only in relation to humanitar- ian aid to the Vanni region. This is not what is required from India, says Mano Ganeshan, MP and leader of the Western People’s Front (WPF).
The Joint Press Released in Delhi on 26 October 2008 states - “Keeping in mind the close bilateral relations between India and Sri Lanka, President of Sri Lanka Ma- hinda Rajapaksa sent as his Special Envoy Honourable Basil Rajapaksa, Member of Parliament and Senior Advisor to the President of Sri Lanka to visit New Delhi, on 26th October 2008. During his visit, the Sri Lankan Special Envoy held discussions with External Affairs Minister, National Security Advisor and Foreign Secretary.
“The Indian side appreciated deeply the initiative of President Mahinda Rajapaksa to send his Special Envoy. The discussions were positive and constructive and centered around a range of issues.
“India conveyed its concern at the humanitarian situation in the northern part of Sri Lanka, especially of the civilians and internally displaced persons caught in the hostilities and emphasised the need for unhindered essential relief supplies. Mr. Rajapaksa briefed the Indian authorities of the efforts by the Sri Lanka Govern- ment to afford relief and ensure the welfare of the civilian population in the North. He assured that the safety and wellbeing of the Tamil community in Sri Lanka is being taken care of.
“As a gesture of goodwill, India has decided to send around 800 tonness of relief material to Sri Lanka for the affected civilians in the North. The Government of Sri Lanka will facilitate the delivery. Both sides agreed to consult and cooperate with each other in addressing these humanitarian issues.
“Both sides discussed the need to move towards a peacefully negotiated political settlement in the island including in the North. Both sides agreed that terrorism should be countered with resolve. The Indian side called for implementation of the 13th Amendment and greater devolution of powers to the provinces. Mr. Basil Rajapaksa emphasized that the President of Sri Lanka and his Government were firmly committed to a politi- cal process that would lead to a sustainable solution.
“Both sides agreed to further nurture the democratic process in the Eastern Province. Mr. Rajapaksa briefed the Indian side of the large development effort underway in the Eastern Province.
“With regard to issues relating to fishermen, in view of the humanitarian and livelihood dimensions in- volved, both sides agreed to put in place practical arrangements to deal with bona fide Indian and Sri Lankan fishermen crossing the International Maritime Boundary Line and to continue discussions on the proposed MOU on development and cooperation in the field of fisheries.
Discussions in New Delhi during Mr. Rajapaksa’s visit were characterized by a spirit of constructive en- gagement on both sides. Both Governments will remain in close touch.”
Tamil activists argue that Tamil Nadu can exert only so much of influence within the Indian political matrix, and the momentum created by the political campaigns in Tamil Nadu must be maintained by lobby at the New Delhi level. While continuing to ensure that the interests of Tamil Nadu on the continuing crisis in Sri Lanka are sustained, we need to take the Tamil national question beyond Tamil Nadu to Delhi where the crisis must be addressed. All energies should be directed to force policy shifts both in India and Sri Lanka on the Tamil national question.

●Environmental justice denied to minorities in Sri Lanka: The Tamil speaking minorities and people with low income are reported to have less access to clean water and sanitation, and are at greater risk of exposure to environmental hazards than the majority and the economi- cally well-off communities. Environmental laws are not equally applied, and these communities suffer from lack of access to information, par- ticipation in decision making, and justice in matters related to the environment. The social and human rights activists are calling for an end to environ- mental discrimination.
●Kilinochchi medical sector appeals for help: The Kilinochchi Medical As- sociation (KMA), in a letter to the Government Medical Of- ficers’ Association (GMOA) Colombo has appealed for assistance to deal with the humanitarian crisis following military offensive in the LTTE controlled areas of Vanni. The communication states that the displacement has caused a major challenge to the medi- cal sector which is running with limited cadre and in the face of air attacks on hospital facilities, to deal with huge number of children with dys- entery and gastro-enteritis.
The letter further adds that in order to save valuable medical equipment from attacks and to provide medical assistance to the displaced population, they have decided to move part of the Kilinochchi Hospital to a government school - Visu- vamadu Maha Vidyalayam - and to a peripheral unit at Tharmapuram.
The KMA appeal requests the GMOA to address two issues: a) to help the IDP families to resettle outside the school premises; and (b) help to facil- itate the school administration to continue the functions of these schools without inter- ruption.
The letter also stresses as follows: “As we are doctors representing the Sri Lankan Government in the health sec- tor, it is our responsibility to look after innocent Sri Lankan citizens of these areas and we believe that we have the right to demand our government on behalf of our people”.
●Sinhalization of the East: The Coalition of Tamils and Muslims in the Eastern Region (CMTPC) continue to express its concerns over government policies aimed to
redefine geographies and de- mographics of the region. The organization says that the cur- rent government policy is set- ting a dangerous precedence in the Sri Lankan conflict and would impact on the people’s ability to engage in social and political organisation, and would make serious inroads into their economic existence.
The new flag for the Eastern Province, introduced by the government, displays three animals: a lion symbolizing the Amparai district, an eagle for Trincomalee and a fish for Batticaloa. Batticaloa has long called itself the land of the “singing” fish, but the reasons for choosing an eagle for Trincomalee is unclear. The use of the Sinhala lion to represent the Muslim dominated Amparai district seems to have a motive: erasing the Muslim presence in the east. The introduction of the symbols shows the realities that the minorities face in Sri Lanka. The government’s programme of wiping out their cultural identities is in place in the East.
●Freedom of Expression: Following its third visit to Sri Lanka between 25-29 October, the International Federation of Journalists (IFJ) has expressed concern over the deterioration in the human rights situation for the journalists. According to IFJ, the most serious developments has been the use of terrorism legislation, for the first time in the democratic world, to punish journalists purely for what they have written. J.S. Tissainayagam, B. Jasiha- ran and V. Valarmathy have been detained since March 2008 and in the case of the first-named, the Prevention of Terrorism Act (PTA) was invoked well after the period of three months stipulated for bringing charges. The Federation has also placed on record its concern over the dangerous prec- edent the prosecution of Tissainayagam, Jasiharan and Valarmathy sets for all media nationally and internationally. It has held that these deten- tions are a gross violation of the public right to know and the accepted norm that media sources should be protected. It further added that the media in the North and East of the country suffer from the worst forms of insecurity. Quite apart from the threats to the life and liberty of media personnel, the IFJ mission found evidence of a legislative effort to curb media independ- ence. Media rules gazetted on 10 October 2008 by the Sri Lankan government provide
for a number of contingencies under which broadcasting licences could be cancelled, including seven different grounds related to broadcast content. Broadcast channels will now have to apply annu- ally for licence renewal.
The mission also placed on record its dismay at the repeated instances of elected representatives and high officials of the government using violence and inflamma- tory language against media workers and institutions. The mission found that state- owned media, including the website of the Ministry of De- fence, have contributed to the vilification of the independent media. Such actions were quite transparently, aimed at discrediting independ- ent media. They contributed to a climate of intolerance and hostility towards media institutions perceived to be independent, posing a clear and present danger to the lives and safety of journalists.
●Need to protect migrant workers: At a meeting organ- ized by the UNDP Regional Centre, Colombo on “Women migrants and HIV: from Asia to the Arab States”, a panel experts present said, “There is an urgent need to address the HIV vulnerabilities of Asian migrant women in Arab countries so that the economic gains of the countries of origin and host countries, as well as the health and rights of the migrant women are protected. According to the experts, while the migrant workers generated substantial benefits to their countries of origin as well as the host countries, a large number of them are vul- nerable to HIV because of the unsafe conditions under which they migrate and live.
Ms Thishanthi Mestiyage presenting her paper on “Sri Lankan women migrant work- ers and some critical issues re- lated to their migration”, at the Tamil Women Development Forum’s Gender Conference in May 2008 in London said that in the year 2000, it was estimated there were 858,000 migrants from Sri Lanka and amongst them 590,420 are women migrant workers from rural areas, married and have small children. Of these migrant women, 85% are between the age group of 20- 35. This number according to her had increased substantially due to poverty and continuing armed conflict. It should be noted that substantial numbers of them are from the northeast Tamil homeland.
